Genius Infotech respects your privacy. This Policy explains what information we collect, why we collect it, and what we do with it, in respect of both visitors to geniusinfotech.in and clients who engage our services.
This Policy is published in accordance with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and reflects the principles of the Digital Personal Data Protection Act, 2023.
1. Scope of this Policy
This Policy covers personal data we collect as a data fiduciary. Where we process data inside a Client Account on a Marketplace, that data is governed primarily by the Marketplace's own privacy terms and by the Client's own obligations as the account owner; we act on the Client's instructions in relation to it.
2. Information we collect
Information you give us
- Name, business name, email address, telephone number and message content submitted through our contact or enquiry forms;
- Billing details including address and GSTIN, where you engage our services;
- Correspondence with us by email, WhatsApp or telephone.
Information collected automatically
- IP address, approximate location, browser and device type, operating system, referring page, pages viewed and time spent, collected through analytics cookies.
We do not knowingly collect sensitive personal data such as financial account numbers, passwords, biometric data or health information through this website, and we ask that you do not send such information to us by email or messaging.
3. Account access and client business data
Where you engage us to manage a Marketplace account, you may grant us access to that account. In that connection:
- We prefer delegated or sub-user access granted through the Marketplace's own permission system, rather than sharing of primary login credentials.
- We use such access only to perform the agreed services.
- We may access business data such as orders, settlements, listings, advertising reports and performance metrics for the purpose of performing the services and reporting to you.
- You may revoke access at any time, and should do so on termination.
- We do not sell, rent or trade client business data.
4. How we use information
- To respond to enquiries and provide quotations;
- To deliver, manage and support the services you engage us for;
- To raise invoices, collect payment and meet tax and accounting obligations;
- To prepare reports and communicate with you about your account;
- To improve our website and services;
- To maintain records of instructions, approvals and work performed, including for the purpose of establishing, exercising or defending legal claims;
- To comply with law and respond to lawful requests from authorities.
We do not use client data for automated decision-making or profiling.
5. Consent and lawful basis
We process personal data on the basis of your consent, given when you submit a form or engage our services, and where processing is necessary to perform our contract with you or to comply with a legal obligation. You may withdraw consent at any time by writing to us, though this may prevent us from continuing to provide services.
6. Sharing and disclosure
We do not sell your personal data. We share it only:
- With Marketplaces and advertising platforms, as necessary to perform the services;
- With service providers who support our operations, such as hosting, email and analytics providers, under appropriate confidentiality obligations;
- With our accountants, auditors or legal advisers, where necessary;
- Where required by law, court order, or a lawful request by a government authority;
- Where necessary to establish, exercise or defend a legal claim.
7. Cookies and analytics
This website uses cookies to operate correctly and to understand how visitors use it. We use Google Analytics, which sets cookies and processes usage data on our behalf; Google's own privacy terms apply to that processing.
You can block or delete cookies through your browser settings. Doing so may affect how parts of the website function.
8. How long we keep information
- Enquiry and contact form data: up to 3 years from last contact.
- Client engagement records, correspondence, instructions, approvals and reports: up to 8 years from the end of the engagement, to meet tax and record-keeping obligations and to preserve evidence of instructions given.
- Invoices and accounting records: as required under applicable tax law.
- Analytics data: as per the retention period configured in Google Analytics.
We may retain information for longer where necessary in connection with an actual or anticipated legal claim.
9. Security
We apply reasonable technical and organisational security practices appropriate to the nature of the data we hold, including access control, use of reputable hosting, and limiting access to personnel who need it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for the security of your own devices, email accounts and Marketplace credentials.
10. Your rights
Subject to applicable law, you may ask us to:
- Confirm what personal data of yours we hold, and obtain a summary of it;
- Correct or complete inaccurate or incomplete data;
- Erase data we no longer need, subject to our retention obligations above;
- Withdraw consent to further processing;
- Nominate another person to exercise these rights in the event of death or incapacity.
Write to info@geniusinfotech.in. We will respond within a reasonable period, ordinarily within 30 days. We may need to verify your identity before acting on a request.
11. Children
Our services are intended for businesses and are not directed at children. We do not knowingly collect personal data of persons below 18 years of age. If you believe we have done so, contact us and we will delete it.
12. Changes to this Policy
